California Prostitution Laws & Penalties

Prostitution means engaging in sexual intercourse or any lewd act with another person in exchange for money or something of value. On the other hand, soliciting prostitution means to lure, or attempt to elicit or induce to engage in an act of prostitution. Prostitution, solicitation, and agreeing to engage in an act of prostitution are all considered misdemeanors, punishable by a maximum jail sentence of six months and a fine of up to $1,000.

However, if you are convicted of your second prostitution or solicitation offense, you could be subject to a 45-day minimum jail sentence. If you are convicted of your third prostitution or solicitation offense, you could be subject to a 90-day minimum jail sentence.

There is also the crime of pimping and pandering prostitution. Pimping means collecting all or a partial amount of a prostitute’s play, while pandering is the act of recruiting or encouraging someone to become or remain a prostitute. Both crimes are considered felonies, punishable by a prison sentence of either three, four, or six years.
