Avoiding a DUI this Holiday Season

The holidays typically see a surge in the number of motorists on the road, increased traffic, and a higher rate of alcohol-related accidents. In fact, the American Automobile Association (AAA) estimates that nearly 47 million Americans will travel 50 miles or more just this thanksgiving alone. With the increased rate of drunk driving, the police will be out in full force throughout Thanksgiving, Christmas, and New Year’s Eve. To help you stay safe and on the right side of the law, we have included four tips below for avoiding a DUI this holiday season.

  1. Get a designated driver: If you know that your plans for the holidays include throwing back a few drinks, designating a driver for the night can work to ensure that everyone gets home safe and sound. Consider starting things off by volunteering yourself, asking that someone you drive home will take the responsibility on for an upcoming holiday.
  2. Call a taxi: With the ever-increasing popularity of driver services such as Uber and Lyft, finding a ride home this holiday season may be easier than ever. If there is no availability where you are or taxi services become too expensive, consider taking public transportation. If you do decide to take the bus, remember that many cities implement holiday schedules which can differ from regularly scheduled run times.
  3. Stay the night: Another way to plan for an upcoming celebration can be to stay over your family or relatives. Ask ahead of time if there is an available couch, bed, or even sleeping bag that you may be able to use. You may not be the only one with this plan and if every available area has already been taken, consider renting a room nearby and taking a quick ride over at the end of the night.
  4. Don’t drink and drive: Of course, the best way to avoid a drunk driving charge over the holidays (or at any time of year) is to avoid getting behind the wheel if you have been drinking. The penalties for drinking and driving can be severe and may follow you for years if not decades to come. If the night comes to an end and you’re not sure that you are okay to drive, don’t take the chance.

What Happens If I Am Pulled Over?

If you are pulled over this holiday season, it is critical to remember your rights. Field sobriety tests are optional, you may not have to consent to a search, and you should be careful not to say more than is absolutely necessary. In the event that you are charged with a crime, you have the right to legal representation and you do not have to speak to law enforcement without an attorney from our firm in your corner. At Campbell Whitten, we can help you to understand the nature of your charges as well as your legal options. Contact our Bakersfield DUI attorneys today!
