How Embezzlement is Punished in CA

Embezzlement is a type of property theft that occurs when a person who was entrusted to manage or monitor another individual’s money or property steals all or a portion of it for personal gain. The main factor in any embezzlement case is that the defendant had legal access to someone else’s money or property, but not legal ownership.

In California, embezzlement is punished based on the type or value of the property, or the amount of money stolen. If the property is worth more than $50 and less than $950, the defendant is subject to a misdemeanor conviction that punishable by a maximum prison sentence of six months and a fine of up to $1,000.

On the other hand, if the property is worth more than $950, then it can be either a misdemeanor or felony, depending on the circumstances of a crime. A misdemeanor conviction is punishable by a maximum jail sentence of one year, while a felony conviction results in a prison sentence of 16 months, two years, or three years.

Embezzling public money is also considered a felony, in which the defendant is subject to increased fines and penalties. This can include repayment of stolen funds or property, as well as a prison sentence of two and four years.
